1. Acceptance of Terms

By accessing or using Quick Roster's AI-powered roster management service ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use our Service. These Terms are governed by Australian law and subject to the jurisdiction of Australian courts.

2. Service Description

Quick Roster provides an AI-powered workforce management platform designed for Australian businesses. Our Service includes employee scheduling, award compliance checking, shift management, and related features. We aim to ensure compliance with Australian employment laws and award rates, but you remain responsible for final compliance verification.

3. Account Registration and Eligibility

3.1 Eligibility

You must be:

  • At least 18 years old
  • Legally authorized to enter into contracts in Australia
  • Operating a legitimate business with employees
  • Compliant with Australian employment laws

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized access or security breaches.

4. Subscription and Payment

4.1 Free Trial

We offer a 30-day free trial for new customers. No credit card is required for the trial. At the end of your trial period, your account will automatically convert to a paid subscription unless you cancel.

4.2 Subscription Fees

Subscription fees are billed monthly in advance and are non-refundable except as required by Australian Consumer Law. All prices include GST where applicable. We reserve the right to change our pricing with 30 days' notice.

4.3 Automatic Renewal

Subscriptions automatically renew each month unless you cancel before your next billing date. You can cancel your subscription at any time through your account settings or by contacting customer support.

5. Use of Service

5.1 Permitted Use

You may use our Service to:

  • Create and manage employee schedules
  • Track employee availability and time off
  • Generate compliance reports
  • Manage workforce data for your business

5.2 Prohibited Use

You may not:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Attempt to reverse engineer or hack the Service
  • Share your account with unauthorized parties
  • Use the Service for illegal employment practices
  • Upload malicious software or spam

6. Data and Privacy

Your use of our Service is subject to our Privacy Policy, which complies with the Australian Privacy Act 1988. You are responsible for ensuring you have appropriate consent to provide employee personal information to our Service and for complying with workplace privacy obligations.

7. Compliance and Liability

7.1 Award Compliance

While our Service aims to assist with Australian award compliance, you remain solely responsible for ensuring your employment practices comply with all applicable laws, awards, and enterprise agreements. We recommend regular review with employment law professionals.

7.2 Limitation of Liability

To the extent permitted by Australian Consumer Law, our liability is limited to the amount you paid for the Service in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages, including lost profits or business interruption.

8. Intellectual Property

Quick Roster and our Service, including all software, content, and trademarks, are our intellectual property. You receive a limited, non-exclusive license to use the Service during your subscription. You retain ownership of your business data entered into the Service.

9. Service Availability

We strive to maintain 99.9% service availability but cannot guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for service interruptions beyond our reasonable control.

10. Termination

Either party may terminate these Terms:

  • You may cancel your subscription at any time
  • We may terminate for breach of these Terms with 30 days' notice
  • Immediate termination may occur for serious violations
  • Upon termination, your access ceases and data may be deleted

11. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies rights you may have under the Australian Consumer Law or other applicable consumer protection laws. Where we provide goods or services to consumers, certain guarantees apply that cannot be excluded.

12. Dispute Resolution

Any disputes arising from these Terms will be resolved through good faith negotiation. If unsuccessful, disputes will be subject to the jurisdiction of Australian courts. For consumer disputes, you may also access external dispute resolution through relevant ombudsman services.

13. Changes to Terms

We may update these Terms from time to time. We will provide notice of material changes by email or through our Service. Your continued use after changes take effect constitutes acceptance of the updated Terms.

14. Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, government actions, internet outages, or other force majeure events.
